This Privacy Policy governs the privacy terms of our mobile application, Mobius Kiwi (hereinafter referred to as the "Application"), developed, owned, and operated by Jorge Luis de Castro Inácio (hereinafter referred to as "we", "us", or "our").
We are committed to protecting your privacy and ensuring the security of your personal and technical data. This document outlines how we collect, use, process, and safeguard your information in compliance with global data protection regulations, including but not limited to the Brazilian General Data Protection Law (LGPD - Law No. 13.709/2018), the European General Data Protection Regulation (GDPR - Regulation EU 2016/679), and the California Consumer Privacy Act (CCPA/CPRA).
By downloading, installing, or using the Application, you explicitly agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with any terms herein, please do not use the Application.
1. Information We Collect
As a specialized network diagnostics and utility toolkit, the Application processes data necessary to execute technical commands requested directly by the user.
A. Technical and Network Diagnostic Data (User-Initiated)
The Application processes technical metadata required to perform network diagnostics, including:
Internet Protocol (IP) Addresses: Used to perform Pings, Traceroutes (MTR), Whois lookups, and DNS resolutions.
Network Metadata: Autonomous System Numbers (ASN), BGP routing paths, CIDR blocks, MAC addresses, ISP identification, Wi-Fi Service Set Identifiers (SSID), and signal strength.
Local Network Topology: Information regarding connected devices detected during user-authorized local subnet scans (Port Scanning/Discoveries).
Performance Metrics: Latency, jitter, packet loss percentages, and connection throughput speeds.
B. Device and Log Information
To ensure Application stability and performance, we may automatically collect:
Device hardware model, operating system version, and system language.
Application crash logs, error reports, and performance diagnostics (processed via standard Android APIs).
C. Sensitive Data and Personal Identifiable Information (PII)
No Account Registration: The Application does not require user account creation, registration, names, email addresses, or financial information to function.
Location Data: The Application may request access to coarse or precise location permissions strictly because the Android operating system requires these permissions to read Wi-Fi network information (SSID/BSSID). This data is processed locally on the device and is never transmitted to external servers or used for user tracking.
2. Legal Basis for Processing (LGPD & GDPR)
We only process data under valid legal frameworks, which include:
Performance of a Contract: To provide the specific network analysis, diagnostic tool, or utility service explicitly triggered by you within the interface.
Legitimate Interests: To improve application stability, optimize performance, and ensure infrastructure security.
Compliance with Legal Obligations: To comply with applicable laws, judicial orders, or regulatory mandates.
3. How We Use the Collected Information
The technical information processed by Mobius Kiwi is utilized exclusively to:
Render real-time diagnostic reports (Ping, Traceroute, Whois, DNS, and Subnet Scans) on your screen.
Troubleshoot application crashes, fix software bugs, and optimize the user interface across various form factors (smartphones, tablets, and Chromebooks).
Maintain the security and integrity of the local execution environment.
Data Commercialization Statement: We do not sell, rent, lease, trade, or monetize your technical or personal data to any third-party marketing companies, data brokers, or advertising networks.
4. Data Sharing and Third-Party Services
We do not share your information with third parties, except in the following limited circumstances:
Public Network Infrastructure Queries: When executing Whois, DNS Lookups, or GeoIP requests, queries are naturally transmitted to standard public internet registries, authoritative DNS servers, or public API endpoints to fetch the requested technical data.
Legal Requirements: If required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency).
5. Data Retention
Technical diagnostics executed within the application are transient, processed in volatile memory, and are not persistently stored on external cloud databases. Any diagnostic logs generated during your session remain strictly on your local device storage and are wiped upon application closure or manual user deletion.
6. International Data Transfers
As an application with a global reach, any minimal diagnostic data query handled by public internet infrastructure (such as standard DNS or Whois routing) may transit through servers located outside your home country. By using the Application, you acknowledge and consent to these standard international technical routing protocols.
7. Your Privacy Rights
Depending on your geographic location, you possess specific statutory rights regarding your data:
Brazil (LGPD): You have the right to confirm the existence of processing, access your data, correct incomplete or inaccurate data, anonymize or block unnecessary data, and request information about public/private entities with whom data was shared.
European Union & United Kingdom (GDPR): You hold the right to access, rectify, or erase your data, the right to restrict or object to processing, and the right to data portability.
United States / California (CCPA/CPRA): You have the right to know what data is collected, request its deletion, and confirm that your data is not sold or shared for cross-context behavioral advertising.
Since the Application operates locally and does not map data to specific user identities or personal accounts, exercising these rights is inherently respected by the non-retention structure of the app.
8. Children’s Privacy
The Application is targeted toward network engineering professionals, IT students, and infrastructure technicians. It does not knowingly collect or solicit personal information from children under the age of 13 (or under 16 in the EU/Brazil). If you believe a minor has provided us with personal data, please contact us immediately so we can take remedial action.
9. Changes to This Privacy Policy
We reserve the right to update or modify this Privacy Policy at any time. Any updates will be published directly within this document with an updated "Last Updated" date. We encourage you to review this Privacy Policy periodically to stay informed of our data protection practices.
